Two Maui residents are to contest citations they received for jet ski usage around Kaunakakai harbor back in May.

Tom Stone, who received a citation along with Darrick Doerner, said he had been offered a plea bargain on his last appearance in court for the two citations he received. This would have involved dropping one of the citations if he agreed to pay the other.

Stone said that he would be receiving legal representation for a further court date on Oct. 14. Speaking about why he would be contesting the citations, Stone said there were a number of factors. One involved his ability to use his jet skis for “transportation” reasons and not for “Recreational Thrill Craft Operations” as stated on his citation. Another reason is to hopefully get some clarity about the law regarding jet ski usage around Molokai.

Current rules enforced by the Department of Land and Natural Resources state that jet skis and other personal watercraft are legal on Oahu, Maui, Kauai and Big Island, 500 feet from the shoreline (or outer fringe of barrier reef) to two miles off the coast, in certain designated areas. The bone of contention for some appears to lay in the fact that Molokai, like Lanai, are not specifically mentioned in the rules.

That there are grey areas and unclear rules have been admitted to in the past by DLNR officials. Back in March, Randy Awo, DLNR branch chief for Maui County, said that, “the discussion would be black-and-white if the legislators had said ‘no jet skis.’ But the state instead said that the area has to be designated.” Awo also said that the DLNR inherited the current boating statutes in 1996 and that they are presently, "the most convoluted rules ever written."

Back in May, the DLNR held an informal meeting to discuss the ban of jet skis on Molokai. Roughly three-quarters of those that spoke favored modifying the law. In June an open discussion was held on the issue of jet skis with two DLNR representatives. At both meetings, Nicholas Giaconi, DLNR’s district manager, suggested that an advisory committee be created for the issue.

Recently, Laura Stevens from the DLNR Public Information Department, said that the Division of Boating and Ocean Recreation (DOBOR) will be systematically reviewing its administrative rules and working to improve them over the next few years through a rule change process.

Stevens added that DLNR Staff are reviewing comments and assessing what steps should be taken moving forward. According to the DLNR, public opinion regarding the Molokai thrill craft meeting showed that residents were divided with the majority being against recreational thrill craft operations in waters surrounding Molokai.

Comments

Although I generally feel that there should be fewer government restrictions on people, I have to say I don't really see any public benefit to having jet skis.

They may be fun for the 1 or 2 people riding them and provide income to those who sell or rent them, but they are noisy and polluting for every other living thing around. Not good for the fish or ocean as I understand they leak oil or gas.

Transportation? It's possible... but sounds more like he's trying to make a silk purse out of a sow's ear. I wouldn't really want jet skis on Molokai. Maybe he could try Lanai, they might go for it.

Tom Pohaku Stone will be presenting an opening Hawai'ian blessing for the (IBWSS) 2008 International Boating and Water Safety Summit proceedings in San Diego, California. Education has proven the link from the past into the future as Tom's opening theme for the IBWSS proceedings to get underway with a resonating and deeply moving invocation to the IBWSS membership.

The IBWSS is from April 16-19th. Nature, God, and man are all sources of knowledge; they inspire us. The Hawaiian views 'knowledge' as holistic and multi-faceted: all knowledge is not contained in one place. Knowledge is a merging of the head, heart and the whole body. Knowledge is acquired from many sources.

The Hawaiian people have always been aware of their ocean environment and its many moods and rhythms. Ka Makani ‘ula o ke kai – the red wind that belongs to the sea. What this means is that the blood that flows through us is the wind of our ancestors who gave up the land to become a sea going people of this great world we call home – we are all one people of this canoe. Our ancestors embraced the knowledge of the gods to care for the land and the sea by identifying and maintaining a harmonious relationship with their fragile island resources.

From this concept of Mālama our kūpuna established th e foundation of our culture and our relationship to the ocean. Though similar in some ways to other Pacific island cultures, our unique culture remains very different from any other Pacific isle peoples. If we do not continue to Mā lama then we will have failed as people and we will stand to lose our living culture. Malama Kai – Our precious marine ecosystems, including important fishing grounds, coral reefs, beaches, and surf sites are being impacted, but we are here to care for it. The sea is a lei around our islands in the sea of which our ancestors emerged from and had respect for this sea, and the aspects of their well-being was reliant upon it. Malama kai – care for the sea and take from it only what is needed and to respect its godly power.

Surfersvillage Global Surf News, 22 February, 2008 : - - Kanalu K38 instructors Tom Pohaku Stone and Pake Ah Mow volunteered for a Rescue Water Craft (RWC) awareness demonstration for the Boarding House Mentor organization and visiting as part of a Kanaluy K38 Hawaiian volunteer community service.

This program reviewed the RWC surf rescue techniques used for assisting swimmers, beachgoers and surfers in distress for recovery from life threatening situations back to safe shore. This was a cultural exchange for the students who were on a visitation tour, and were meeting up with notables of the Hawaiian surfing heritage, 'our legends of today', shaping the future of tomorrow with the Spirit of Aloha!

Josh Grisby on the trip:What a trip. I feel like I won a surfing game show and the prize was a ten day trip to Hawaii to surf and meet all the people you have ever wanted to meet in the surfing world. I will never forget Tom and Pake on the Jet Skis (Kanalu K38), Rabbit, all the big wave chargers at the Eddie, Brian taking us paddle surfing. More important to me though than meeting all these people was the Aloha they showed us.

I have never met Liam McNamara before but he gave us a board from his shop to use for free. The way Tom his wife and Pake took us in for a huge dinner like we where family. The way the guys at the Volcom house where really stoked to meet Floyd and Esteban. Brian introducing us to everyone in Makaha.

As a surfer you hear stories of the locals hassling the mainlanders and I am sure there some of them are true but let me tell you this. I feel more comfortable surfing here with the locals than my home break that I have been surfing for 25 years. Aloha is alive and well here in Hawaii and I am really going to try and remember that when I am stuck in traffic or having a bad day at work. To all my new friends here in Hawaii I say Mahalo and Aloha.

Tom Pohaku Stone and Darrick Doerner representing Kanalu K38 and the American Watercraft Association H2O Responders (AWA), have left the island of Oahu this morning at 7:30am to transit across the channel to Kaunakakai Harbor to attend the DLNR meeting.

Preparations began two days ago when the notice was issued for the public meeting regarding personal watercraft.Many people are not able on such a short notice to attend due to work schedule and financial demands.

'We recognize it is important for us to step forward to listen to the community concerns and the DLNR response as representatives of the future of personal watercraft access related issues', states Tom.

Both Tom and Darrick are carrying emergency equipment, communications and are familiar with the transit, which will be approximately 80 miles round trip from Kaneohe Bay.The meeting is being held from between 2-3 PM, it appears a petition has been circulated on Molokai to support the legalization of PWC riding.

The meeting is designed to hear directly from residents regarding concerns about PWC use in their waters, and those who own or operate PWC. It is a beginning of a process of fact finding and administration concerns.

Kanalu K38 Water Safety provides services for public safety agencies such as lifeguards, fire rescue, law enforcement training, Search and Rescue and or volunteer groups using Personal Watercraft (PWC).

For reference, Personal Watercraft are referred to as Rescue Water Craft (RWC) for occupational use.K38 provides PWC boating safety instruction for recreational boaters, working in partnership with the National Association of Boating Law Administrators (NASBLA) the National Safe Boating Council (NSBC), and it's partners the Water Safety Congress (WSC) and others in reducing or preventing deaths or injury from boating related incidents.

Kanalu K38 provides consultation and event management services for athletic programs and events, media relations or the film industry.K38 trains federal agencies such as the USCG and special waterborne divisions of the US Navy and the USMC for the use of Personal Watercraft for safety, task force protection and counter terrorism. We provide classroom materials and Personal Watercraft for the practical training needs of our students. It is approved by the National Association of State Boating Law Administrators (NASBLA) and the Hawaii Department of Land and Natural Resources' Division of Boating and Ocean Recreation (DOBOR). Passing the PWCSafetySchool.com course is the FIRST step toward earning a Hawaii Boater Education Card.

Completing the exam and certification process with KANALU K38:

Upon the successful completion of the PWCSafetySchool.com course you will be provided a PWCSafetySchool.com Certificate of Completion (CC) Number. The next step is to go to KANALU K38 www.kanalu-k38.com. Fill out the application form provided. You will be assigned a Hawaii Boater Education Card (HBEC) Application Identification Number. You will need both the CC Number and HBEC Identification Number to apply for and receive your official Hawaii Boater Education Card.

Your paperwork will be processed and your one-year temporary PWC/Boating Safety I.D. Card will be mailed to you within 2 weeks for DOCARE/DOBOR recognition purposes. The fee is $15.00 (payable to KANALU or use the Paypal icon to make a credit card payment online). Your permanent documents will be mailed to you. Your I.D. card and certificate are proof of successful completion of this course.

Be sure to include your PWC Safety School certificate number to receive your permanent HBEC card after payment process is completed either online or upon receipt of payment. All PWC owner/operators once provided with the Certification and Hawaii Boater Education Card must register for a classroom and practical course offered by KANALU K38. The practical component must be completed within one (1) year.

Upon satisfactory completion of classroom and practical, a validation decal, certificate, and card will be issued that must be renewed every three years.

The validated HBEC decal will allow the PWC owner/operator to access any and all State waters where PWC's are allowed according to the Hawaii revised Statutes and Hawaii Administrative rules. Note - to be certified for Tow-surfing through KANALU K38 the individual must complete the above process first.

Although focusing on safe use of a personal watercraft, this course covers all aspects of safe boating as required by NASBLA and the Department of Land and Natural Resources, Division of Boating and Ocean Recreation (DOBOR) - State of Hawaii.
